Abstract

BPJS Kesehatan, as described in Article 1 paragraph (2) BPJS Health Regulation No. 1 of 2014 on the Implementation of Health Insurance is a legal entity established to organize a health insurance program. Thus, BPJS Health guarantees the implementation of health insurance. On the other hand, according to Article 46 of Law no. 44 of 2009 on Hospitals, RS is the organizer of health program responsible for the losses suffered by patients for health services he held. Research Objectives: To find out how the legal protection of patients inpatient BPJS health in accessing health services at RumahPakitWilasa Semarang Hospital. MethodThis research uses qualitative method with sociological juridical approach. The research specification used descriptive analytical. Collection method is done by interview. This type of research data is primary data and secondary data and data collection using literature study. The results of the study showed that the legal protection of patients participanting Bpjs health in conduting hospital in the hospital from the aspect of regulation has been fulfilled their rights both as hospital patients and as Bpjs health participants. But in its application there are still shortcomings that lead to patient dissatisfaction with hospital services, such as lack of information provided by the hospital to Bpjs health parrticipants. The legal effort that has been made by the health Bpjs in order to fulfill the rights and obligation of the patient in placing some Bpjs health officers in the hospital to handle the complaint procedure by the Bpjs health participants. In addition, the Bpjs health office put up dashboard information on the number of available rooms in order not to happen. Other efforts to fulfill the rights and obligations of the patient Bpjs health is to make mediation efforts to the parrticipants Bpjs health and the hospital if necessary.
