Abstract
Fixed orthodontic services should be the authority of orthodontic dentists. However, currently there are many general dentists who carry out this service because they feel they have the ability gained from a course without a mechanism that is in accordance with Law No. 29 of 2004 concerning Medical Practices. Various adverse effects can occur if the treatment is carried out without competency and authority. The purpose of this research is to find out the form of legal accountability of general dentists who take actions beyond their competence and authority regulated in the legislation. Research conducted using sociological juridical methods with descriptive-analytic specifications. Respondents were 19 general dentists who had fixed orthodontic services and patients who received fixed orthodontic services. The resource persons in this study were the Head of the Semarang District Health Office, the PDGI Chair of Semarang Regency, and a health law expert. The results showed that there were 19 PDGI members of Semarang Regency's general dentists performing fixed orthodontic services. Most of the respondents know that they only do on the removable orthodontic service but due to their little ability in doing fixd orthodontic, they tried to do so. Fixed orthodontic services performed by general dentists were beyond the authority and it was the violation of state administration. However, the violation could be held liable for civil or criminal liability if the victim made a claim for the loss suffered. Until now, there was no reports to the Semarang District Health Office and PDGI Semarang Regency regarding the losses suffered by patients. Keywords: liability, general dentist, fixed orthodontics.
