Abstract
Health was one of human rights and this meant that every person had the right to health care for his or her health sake. The rights to health care written in Article 49 paragraph (2) of the Act Nr. 39 of 1999 on Human Rights were about rights of special health service to pregnant mothers that were to get antenatal care. Antenatal care during pregnancy included early detection of infectious diseases from mothers to their babies as set out in Article 12 of the Minister of Health’s Regulation Nr. 97 of 2014 on Pre-Pregnancy Health Services, Pregnancy, Delivery and Postpartum Period, Contraception Service, and Sexual Health Service. Hepatitis B was one of mother-to-baby-transmition diseases. The screening was only required to mothers who would have sectio caesareain Darmayu general hospital. The legislation implementation related with hepatitis B could not be separated from legal values, namely expediency, justice and legal certainty. Article 11 of the Minister of Health’s Regulation Nr. 53 of 2015 on Hepatitis Handling explained that the secreening hepatitis for pregnant woman was only a recommendation not an obligation. Therefore, Darmayu General Hospital did not violate the regulaion if it required a screening only to patients of sectio caesarea, and not implementatition legal value of justice. Darmayu general hospital do fraud and all patient must pay screening of hepatitis B. This made some patients refuse to have the screening. The awareness of the public, health personnel and government remained low so they had not been aware of Hepatitis B dangers. The hospital was lack of Hepatitis B reporting and there was no medical record of patient having Hepatitis. One of the supporting factors of Hepatitis B screening implementation at Darmayu General Hospital was the standard operating procedure requiring patients of sectio caesarea to perform the screening. The hospital’s commitment to provide information and education to all patients at midwifery and womb ward had made the patients aware of the importance of hepatitis B screening.
