Abstract
Regulations about patient safety are guidelines to ensure the safety of the patients in healthcare service. The regulations specifies standards that mainly focused to increase awareness in preventing medical risks and malpractices which can harm patients in various ways. The principle pf protection is general principle in public service that highly values sense of security. It is supported by the principle of legal certainty and the principle of "pengayoman" to give a sense of justice. Consequently, a question arises: do regulations about patient safety comply with the principle of protection? This is a descriptive research with a juridical normative approach. The purpose of this study is to establish working hypotheses that can serve as basis for future research. Permenkes Nomor 11 Tahun 2017 tentang Keselamatan Pasien contains set of legal norms which regulates patient safety in healhcare facilities. It comprises of rules about patient safety standard, patient's rights standard, patient and patient's family education standard, performance improvement method standard to evaluate and do patient safety enhancement program, National Committee of Patient Safety, Patient Safety Team on healhcare facilities, leadership standard to increase patient safety, standard of patient safety education to personnel, which all aim to increase the quality of healthcare services. Legal principles are principles containing precious basic values. Principle of protection is one of the most important principle in public service that can bring sense of security into reality. It is actualized in rules to provide legal certainty and legal justice. The principle is a manifestation of principle of "pengayoman" as well, which is an authentic principle of Republic of Indonesia. Principle of protection aims to realize safety, happiness, and comfort appropriately with the ideal of "pengayoman" based on the principles of Pancasila. One of the most important element of healthcare service is patient safety. The goal is to increase healthcare quality so stakeholders can avoid medical risks and malpractices. As a general principle in public service, principle of protection is supported by principle of legal certainty and "pengayoman" which are the foundation of ideals of Pancasila. Therefore, regulations about patient safety complies with the principle of protection.
