Abstract
Article 47 paragraph (2) of the Act Nr. 29 of 2004 on Medical Practices stated that medical records should be kept confidential by doctors or dentists and management of health facilities. Although it was confidential the medical records could still be used for health insurance purposes. The proposal of insurance claim of BPJS of Health also used medical record information data. Therefore, the hospital required a good information management to manage the use of medical record information in the proposal of BPJS of Health insurance claims to avoid unauthorized access to medical record information. In the process of proposing an insurance claim unauthorized access was often found that were non in accordance with the prevailing legislations. Based on this fact, the researcher was interested in conducting research to find out how the setting, the implementation, and the factors influencing of the patient’s protection against the use of medical record information of the proposal of BPJS Health insurance claim. This research applied socio-legal approach having analytical descriptive specification. The research was conducted at Dr. R. Ismoyo Army Hospital of Kendari City, Southeast Sulawesi. The sampling was purposive sampling. The data were gathered by literature and field studies and they were then qualitatively analyzed by using legislations. The existing legislations had guaranteed the patient's legal protection against the use of medical record information in relation with BPJS of Health insurance claim. Internal regulations made by Dr. R Ismoyo Army Hospital had not protected the patient's against the use of medical record information in relation with BPJS of Health insurance claim. There were some factors influencing these matters, among others, juridical factors (hospital regulations or hospital bylaws) and technical factors (officers, patients, and supervision).
