Abstract

Midwive’s independent practices were to be the spearhead in implementing maternal and children services provided through midwifery care services that were included in National Health Insurance (JKN) program. The midwifery service kinds that could be provided through JKN program according to PMK Nr. 69 of 2013 included ANC, normal vaginal delivery, post-miscarriage bleeding, implant family planning services, injections, IUDs and pre-referral services. The problem was that 95% of Demak District residents had become JKN-KIS participants but the midwives who did independent practices and were registered as networking midwives were only 11. It, therefore, resulted JKN participants’ rights to obtain health services failed, especially midwifery services due to the limited number of networking midwives. This was a socio-legal study having a descriptive-analytic specification. It used primary and secondary data. The data gathering techniques were conducted by field and library studies. The data obtained were then qualitatively analyzed. The results of the study showed that the of midwives’ independent practices in implementing JKN through midwifery care services at Demak District had mostly been based on the prevailing legislations, namely 1945 Constitution, the Act on SJSN, the Act on Health, the Act on BPJS, and the Act on Health Workers. The form of the regulations were set forth in Minister of Health’s Regulation (Permenkes) Nr. 71 of 2013 saying that a member of networking midwives should fulfill qualifications in the form of having SIP, having NPWP, having a cooperation agreement on FKTP. The authority of the networking midwives, if analyzed, was attributive authority because it was derived from legislations. The imperative role (mandatory) conducted by the networking midwives atDemak District were to carry out midwifery and neonatal services beside making records and reports on midwifery services provided by JKN program. Meanwhile, the facultative role (not mandatory) were in the forms of services supporting JKN’s service quality such as classes for pregnant women and baby massage. There were supporting factors to the midwifery services in JKN program, namely the availability of the health facilities and resources. The inhibiting factors, on the other hand, were technical, namely very little rewards, JKN regulation that was still too general, not particular. Besides, there was a social factor inhibiting, namely the public perception on generic drugs that would not cause the patients not recover quickly.
