Abstract

Nurses conducting practices at Puskesmas (Health Centers) carry out both nursing practices and duties as government employees. They need legal protection and certainty beside protection of other rights as nurses employed by the government based on an employement agreement. This study aimed to see the regulation and implementation of the legal protection for the govenment employed nurses based on an employement agreement (PPPK) beside to find out the supporting and inhibiting factors of the legal protection for the govenment employed nurses based on an employement agreement. This study used qualitative method implementing socio-legal approach. The data were primary and secondary whereas the data gathering techniques were by literature and field studies. The field study technique was conducted by interviews and observations. The literature study was conducted by having primary, secondary and tertiary legal material studies. The interviews were conducted with the parties who could provide information about legal protection for the government employed nurses based on a work agreement (PPPK). The data obtained were then qualitatively analyzed. The results of the study showed that the realization of nurses’ right protection and their other rights were regulated by Local Regulation (Perda) of Central Sulawesi Province Nr. 8 of 2014 on Health Workers Development and the Head of Morowali District’s Decree Nr. 188.4.45/KEP.0091/DINKES/2015 on Appointment of Local Non-Permanent Health Employees of Morowali District and the Decree of Head of Morowali Health Office Nr. 440/43.14/DINKESDA/2015 on the Placement of Health PTT at Morowali District. The local regulations were formed because of concurrent governmental matters. The implementation of Local Regulation (Perda) of Central Sulawesi Province Nr. 8 of 2014 did not conflict with the existing Civil Service Act (ASN) but the Head of Morowali District’s Decree Nr. 188.4.45/KEP.0091/DINKES/2015 and the Decree of Head of Morowali Health Office Nr. 440/43.14/DINKESDA/2015 were practically contrary to the Civil Service Act (ASN) the Government Regulation Nr. 48 of 2018. It could be seen from the implementation of authority delegation of Puskesmas Ulunambo and Bahodopi that were carried out in an unwritten manner. In the practices the appointment of the govenment employed nurses based on an employement agreement (PPPK) was based on the Head of Morowali District’s Decree together with the decree of the Morowali Health Office without any work agreement. The term used for the nurses was non-permanent employess not as government’s employees based on employment agreement. Keywords: legal protection, PPPK nurses, health centers.
