Abstract

Technology provided facilities for business people and consumers to conduct transactions, including the transactions in cosmetic products. Such transactions, including cosmetics marketing through online media, could possibly arise problems bacause the transactions did not bring direct contact between the business actors and the consumers so that the business actors could easily influence the consumers and they were probably not to implement their obligations as a business actors. This fact had triggered many online cosmetics sales who did not have circulation permits whereas the cosmetics could possibly contain hazardous ingredients. The hazardous ingredients could cause permanent damage to the skin and even cancer that could lead to death. This study used sociological-juridical approach, that is related to the regulation of legal protection to the consumers against the cosmetics that were freely sold through online. Besides, this study alsod dealt with the implementation of legal protection to the consumers of cosmetics that were freely sold through online. This was a descriptive-analytic study and the data were qualitatively analyzed. The results of this study showed that there were many referral regulations in providing protection and a sense of security to online cosmetic consumers, such as The Act on Consumer Protection. It also contained the conditions that should be fulfilled by the business actors as well as its sanctions if the regulation was broken. One of the regulations was The Act Nr. 8 of 1999 on Consumer Protection in which the Article 1 paragraph (1) stated: consumer protection is all efforts that guarantee legal certainty to provide protection to consumers. However, the implementation of the regulation had not optimally done due to lack of rights awareness experienced by the consumers themselves so that the government did not focus supervising online cosmetics transactions. Therefore, any effort to implement the regulations of legal protection to the consumers of online cosmetics transactions should be done by all parties involved, namely the business actors, the government, and the consumers.
