Abstract
The Purpose of writing thesis titled “Implementation of Mediator Role in Promoting Successful Mediation in the Court “ is to know how the Implementation of Mediator Role in Promoting Successful in Mediation in the Court, the factor and the matters. In this thesis Research is using juridical approach empirically method with descriptive analitically spesfication research. This research was conducted in the District of Court Tegal and the Religious Court . Collection technique is using indepth interviews to the sources, with the use of data types are primary and secondary data. For analysis Technique and presentation of data is using qualitative analysis methods. This analysis is expected to describe and provide conclusions on the implementation of a mediator role in driving the success of mediation in court Based on the research results of the implementation of a mediator role in driving the success of mediation in court based on the powerful role of the mediator is to prepare and make the minutes of the meeting, to formulate common ground in order realizes that the dispute is not a battle to be won, but the dispute to be resolved, develop and propose alternative solutions, help the parties analyze problem solving, and directing the parties to accept certain proposals for the settlement of disputes. The fifth role is not all done by the mediator judge that mediation success rate in court is very small. While the non-judges mediator slightly better due attention to these five powerful mediator role. The mediator should pay attention to the powerful role to be able to drive the success of mediation in the courts. The factors that drive the success of mediation include a certified mediator, mediator skills, experience, mediator language and options strategy in building motivation. Factor is an obstacle for the success of mediation mediator in encouraging faith in the court is the parties, mediation as a formality and dignity of the parties.
