Abstract
The development of alternative dispute resolution in Indonesia started with the enactment of Act No. 30 of 1999 on Arbitration and Alternative Dispute Resolution (the Arbitration Act). Before the enacment of the Act, dispute resolution was commonly done only in court through the litigation process. The purpose of this chapter is to describe how ADR has developed in Indonesia since the enactment of the Arbitration Act. In this chapter also describes the regulation and various kinds of alternative dispute resolution. This chapter will discuss the development of dispute resolution in court. It should be noted that in Indonesia, methods of ADR such as reconciliation and mediation are integrated in the court process. ADR is used to avoid the courts being flooded with cases, and to help break deadlock between the parties. This is in line with the nature of the Indonesian judicial system, i.e. fast, simple, and inexpensive.
