Abstract
National Narcotics Agency (BNN) of Central Java Province BNN is a governmental institution having objectives to carry out activities of preventing and eradicating narcotics. BNN has three divisions, namely division of prevention and community empowerment (P2M), division of eradication and division of rehabilitation. In 2017 the number of children narcotics users incidence at Semarang City were 117. Legal protection to the children was held by BNN of Central Java Province based on the Act Nr. 35 of 2009 on Narcotics. It was stated that the Provincial BNN (BNNP) had duties and responsibilities of preventing, protecting, and saving the Indonesian nation from narcotics abuse and of eradicating illicit narcotics trafficking and narcotics precursors. The objectives of this study was to get an overview of the implementation of the duties of BNNP of Central Java in order to provide legal protection to children against narcotics abuse and to know the obstacles occuring during the implementation process. This study was a qualitative study having descriptive-analytical specification. This study used primary and secondary data. The data gathering technique was conducted by field studies for the primary and literature studies for the secondary ones. The data obtained were then qualitatively analyzed. The results of the study showed that the implementation of protection to children against narcotics hazards was conducted based on the Act Nr. 35 of 2009 on Narcotics. The protection provided were in the forms of preventive protection carried out by P2M Division. This Division was tasked to carry out the national policies in the forms of information dissemination beside bilateral and multilateral cooperation. Repressive protection was carried out by the Eradication and Rehabilitation Division. The activities of this Division were to form three working groups in the forms of intelligence sections, investigation, prosecution and arrest section as well as the section of supervising prisoners, evidence and assets and rehabilitation activities in providing outpatient and inpatient services. The obstacles found in implementing child protection were lack of public interests in extension activities, budget constraints, limited number of human resources and limited facilities and infrastructure.
