Abstract
Children are the nation’s successor assets so that the State has an obligation to prepare them as healthy, intelligent, and qualified generation. Children’s rights to health are stated in the Article 28 B paragraph (2) of 1945 Constitution. To get such a generation the Government established an indicator in the form neonatal mortality decrease, namely 12 per 1,000 live births and 25 under-five mortality per 1,000 live births. To achieve this the Government then established children's health efforts through Integrated Management of Sick Under Five Children (MTBS) in which the implementation was based the Minister of Health’s Regulation (Permenkes) Nr. 25 of 2014 on Children Health Efforts. In MTBS programs midwives acted as spearheads of the implementation of maternal and child health services at the basic health care facilities, namely Health Center or Puskesmas. This study used a socio-legal approach having a descriptive-analytical specification. Field studies were conducted at Galur Health Center, Panjatan Health Center and Samigaluh Health Center by having interviews as one of the data gathering techniques. Besides, literature studies were conducted by having selected reference books and legislations. The data gathered were then qualitatively analyzed. The results of the study showed that the legal basis of the midwives’ role in implementing MTBS in order to fulfill the children’s rights to health was 1945 Constitution as the highest. It was then followed by Acts, Presidential Regulations, Minister of Health’s Regulations and Regent’s Regulations. All legal basis mentioned above were factually synchronized. The implementation of MTBS in order to fulfill the children's rights was particularly based on the Minister of Health’s Regulation Nr. 25 of 2014. However, there were midwives who did not follow MTBS certified trainings. Some midwives implemented MTBS not based on correct standard operating procedure (SOP) because of their ignorance and there were no SOPs at Galur and Panjatan Health Centers so that the information provision of health and repeat visits were not carried out. The supporting factors in implementing the MTBS programs were medicines, facilities, and infrastructure availability whereas the inhibiting factors were there were still midwives who did not attend MTBS trainings, there were no SOP of MTBS at Galur and Panjatan Health Centers and limited number of the MTBS service providers.
