Abstract

The thesis entitled “The Implementation of Indonesian Legal System and Women Strategy on Legacy Distribution: Study of The Chinese-Indonesian Women in Semarang” proposed to examine the legal system undertook and implemented on legacy distribution to the Chinese-Indonesian women and their legal strategies toward it. Several legal systems can be implemented toward them. They are Indonesian Civil Code and Chinese customary law. Wherein in Chinese customary law, women do not have rights to inherit. Therefore, women have to make decisions and choose strategies in dealing with inheritance matters. The research uses qualitative approach and is under the light of socio-legal approach. The data is collected through interviews to the Chinese-Indonesian daughters in Semarang who were in inheritance situation from their parents. This research finds the implementation of Chinese customary law and Civil Code in the Chinese-Indonesia families. There are also families who use both legal systems, and neither both. However, the research do not find any legal strategy from women. Therefore, Chinese-Indonesian women tend to use non-legal strategy, which is lumping it to avoid potential conflict. Therefore, the research suggests to start raising women’s awareness about their rights. Also, further research also needs to make a linkage between the micro-study and its macro-implications.
