Abstract

ABSTRACT Sale and purchase of land and buildings according to the Basic Agrarian Law must fulfill by the elements of light and cash is meant by customary law. Bright meaning transacted before the Land Deed Officer, and cash settlement means have been done when dealing with Land Deed Officer. Land Deed Officer has the authority to make the deed of sale as the basis for transfer of rights on the ground, which then transition the land rights to be registered at the local Land Office. The rules are written in PP 24 of 1997 of Registration of Land. However, due to the shift register requires conditions that are not easy to fulfill, notary deed made by the authority authorized to sell that is useful to protect the rights of the parties in the interim. The purpose of this paper is to determine the legality of the power sold in the sale and purchase of land and buildings, what happens irregularities in the use of the power to sell the land and buildings as well as the risks for those who commit irregularities in the use of the power to sell the land and buildings, how the misuse of the power to sell the land and buildings occurred and the reason the parties do irregularities in the sale and purchase of land and buildings. The method used in this paper is the juridical sociological, which the authors examined by legislation regulating the above problems by looking at the direct implementation and application of these rules in practice. Methods of data analysis in this paper is descriptive analytical research where in this process actively and subjectively make the process of interpretation, interpretation, and evaluation of the collected data and the theoretical framework based on a growing understanding when interpreting the data. Based on the research results: 1) The power to sell the land and buildings used throughout the legal use in accordance with the substance of the selling power; 2) Irregularities in the use of power selling is violating the provisions of the tax laws and smuggling law, the risk that would be acceptable to those who commit irregularities is authorized to sell the certificate can be applied for cancelation by the Court; 3) The deviation occurs when the use of the power to sell the power to sell following the binding sale and purchase deed; 4) The reason for the parties to make a deviation is due to the difficulty to meet the requirements of the transition signup land rights, whereas in others there are many interests. The conclusion of this paper is allowed to use all the power to sell is used in accordance with the substance of the selling power.
