Abstract

The Minangkabau tribe is one of the ethnic groups in West Sumatra, Indonesia. They are broadly known as those who tend to migrate for economic reasons. Spatiality (the space/locality where the migrants come from), law and power are to be three interrelated components in which its relationship is associated with one another and used in inheritance customary law issues. This study aims to determine the implementation of ‘low’ (individual) inheritance of the Minangkabau migrant families (as opposed to ‘high’ or collective matrilineal-based inheritance) and to find out how customary law and values regarding gender equality have been maintained or shifted over time following migration. This research adopts a qualitative approach. The types of data used are primary and secondary data. The research was conducted in several Indonesian cities and the result shows that the implementation of low inheritance customary law depends on the ‘power’, knowledge of the (inheritance customary) law, and the spatiality in which the family members lived.
