Abstract
Abortion is a highly debated issue from a medical, religious, and legal perspective.One exception form performing an abortion is a medical emergency. The law No. 17 of 2023 regulates the implementation of abortions in hospitals. Hospitals must have a permit, and doctors must be competent and authorized. The research questions are: 1) How are abortion procedures due to medical emergencies regulated in hospitals? 2) How are abortion procedures due to medical emergencies implemented at the Prof. dr. J.A Latumeten Hospital in Ambon? 3) What challenges occur during the implementation of abortion procedures due to medical emergencies at Prof. dr. J.A Latumeten Hospital in Ambon? The research method used is a juridical sociological approach with a qualitative perspective. Data were collected through literature studies and interviews. The results show that 1) Based in Law No. 17 of 2023 Prof. dr. J.A Latumeten Hospital in Ambon does not comply with existing regulations, as the hospital lacks a permit for providing abortion services, and the implementation of abortion procedures is not based on standard operation procedures, clinical practice guidelines and clinical pathway, 2) There is currently no consideration team in place to make decisions on abortion cases, and consent from pregnant women is not reflected in the consent forms for procedures, and 3) There are internal challenges in implementation: doctors are not present when needed, diagnostic support equipment is malfunctioning, and there is a shortage of medications. External factors include medical personnel’s lack of knowledge regarding regulations related to abortion in cases of medical emergencies, difficult access to hospital, and patient’s economic conditions, which can hinder service delivery.
