Abstract

Semarang has the second largest number of elderly people in Indonesia. Elderly people are vulnerable to illness and have the right to health insurance held by the Government. The health insurance rights of elderly are part of social security which is legally protected. The health insurance rights in this study are intended for the membership of the National Health Insurance (JKN) or Semarang Regional Health Insurance. The purpose of this study was to determine the protection of health insurance rights of neglected or poor elderly in nursing homes in Semarang City. The study uses a socio-legal approach. Data is taken through literature and field studies. Field studies through interviews with representatives of Semarang Health Department, Semarang Social Department, Semarang BPJS Health Office, head/caretaker and elderly of three nursing home in Semarang City. Data is analyzed qualitatively. The results of this study found that there was no specific regulation regarding the protection of health insurance rights of elderly in nursing homes. In the field study, it was found that the elderly in the three nursing homes received routine health care. However, related to the membership of health insurance held by the Government, it was found that only 50%, 17% and 8% elderly in the three nursing homes were registered as JKN membership and none were registered in Semarang Regional Health Insurance. The problem are that many elderly people has not been registered because they do not have Family Cards and Identity Cards, limitations of nursing home staffs managing registration, lack of roles and coordination of Local Government institutions in providing health insurance for neglected elderly. Keywords: rights protection, health insurance, elderly nursing homes
