Abstract

A nurse assistant is one of health workers who is graduated from Health Vocational High School (SMK Kesehatan or SPK). The scope of job of nurse assistants sometimes overlaps with ordinary nurses, depending on their competencies and authority. This study used a socio-legal approach having a descriptive analysis specification. The type of data used was primary and secondary that were obtained through field and library studies. The primary data were gathered through interviews and first-hand studies. The data obtained were then qualitatively analyzed by using legal theory, legislations and field findings. The results of the study showed that nurse assistants had a legal position as one of the health workers having duties and responsibilities to help ordinary nurses in providing nursing care based on the existing SOP, ethical principles and professionalism. The legal protection mechanism for nursing assistant practices was carried out through the establishment of nursing committees, policy formulation, HR development, recording, reporting, monitoring and evaluation. The form of legal protection for nurses; assistant practices was STR and Certificate of Competency owned by the nurse assistants so that they could obtain strong legal position when practicing in health services. The hospital granted rights to assistant nurses as hospital employees who were entitled to receive compensation based on a work agreement determined by the management of the foundation legal entity or legal entity, including the rights to legal protection of nurse assistant practices in the implementation of health services. In implementing the legal protection, the hospital was influenced by juridical, technical and social factors. The supporting factors for nurse assistants in getting legal protection was, among others, the existence of nursing committee socializing legal protection for nurse assistants practicing. Another supporting factor was awareness of the ordinary nurses to supervise and record and report if there were incidents. The inhibiting factor was that there were still nurse assistants who did not understand the SOP, lack of awareness as a nurse in carrying out the tasks, due to unbalanced number of patients and nurses, and limited costs and time in conducting training. Nurse assistants in hospitals were not optimal.
