Abstract

This research aimed to find out the legal relationship between patient and partner physician in healthcare service in hospital, the hospital‟s responsibility for the partner physician‟s medical action harmful to the patients, the settlement of dispute between partner physician and hospital resulting from medical dispute, the hospital‟s civil responsibility in medical dispute between patient and partner physician in healthcare service in Temanggung Local General Hospital. This study was a juridical empirical/sociological research that was descriptive in nature, the one emphasizing on juridical and social aspects. The data used in this study was qualitative one, while by its source, the data used were primary and secondary ones. Primary data was obtained through interview, while secondary data through library study. Furthermore, the data obtained was then analyzed using sociological qualitative method. The result of research showed the legal relationship between physician and patient. The legal relationship between patient and partner physician in healthcare service in Temanggung Local General Hospital built on agreement, in which there were right and obligation, because partner physician was not organic physician of Temanggung Local General Hospital. Therefore, partner physician in providing healthcare service to the patients involved hospital ad the provider of healthcare service. The responsibility performed by partner physician based on the work relation and therapeutic relation patterns when medical dispute occurs in the healthcare service organized in Local General Hospital of Temanggung Regency became the Local General Hospital of Temanggung Regency‟s responsibility entirely. The settlement of medical dispute between partner physician and hospital in Local General Hospital of Temanggung Regency concerning the process of settling the case occurring and arising in medical service activity in Local General Hospital of Temanggung Regency performed by partner physician, the medical dispute settlement team will conduct crosscheck and evaluation when the partner physician evidently made fault, and will settle it internally between partner physician and Local General Hospital of Temanggung Regency.
