Abstract

For dental students, getting human tooth with good anatomy is a difficult thing. One of the method is pay a dentist to get post extraction teeth by dentist. This study aims to identification and analyze the legal effects and legal protection of the selling and buying human teeth for dental school by dentist and dentistry student. This research uses normative juridical approach and qualitative research method. The data used is secondary data supported primary data as additional information. Literature study is used to search for materials or secondary data, and interview to get additional information from resource related to execution of selling and buyinh of human teeth between dentistry student with dentist. Result: 60%-80% of dentistry student obtained the teeth by looking to the dentist’s clinic and being charged. This is because students are in need of teeth so willing to pay a certain amount of price. This indicates a defect in the will of misuse of circumstances (misbruik van omstandigheden). In addition, some of the students are not yet 21 years old, causing incompetence in the terms of the agreement. The legal effect of abuse of circumstances and age that have not been proficient in cases of selling and buyinh of teeth to these students can be requested cancellation by dentistry students. As long as there is no legal cancellation of the parent / guardian of the student or student, then the selling and buyinh of teeth post extracted between dentistry students and the doctor remains lawful. Dentist as a bezit over post extracted teeth is legitimate to gives the dentistry student and get legal protection. Dentistry student as buyers who believe in the bezit of a dentist will also be protected by law. This case does not violate Article 64 of the Health Act so that the student and dentist concerned can’t be threatened with criminal punishment as stipulated in Article 192 of the Health Act.
